Many of us go through life without feeling the need for a lawyer, yet, when we are looking for one, we have many questions.  This section addresses many of the common questions we see.  Please be aware that this general information, not legal advice which can only be provided after an attorney is engaged and is aware of your specific circumstances.

I though I had an agreement with someone, is that a contract?

It depends  (you saw that coming, right?) A meeting of the minds can result in a contract, even if it is not written down.  However, there are certain instances where the contract must be in writing.

How can someone sue me when they don't have a case, that seems so wrong?

Anyone that believes that they have a cause of action against you can bring a law suit.   The suit may not yield anything if it is truly baseless, but it can be filed if proper protocols are followed, and the fees are paid.

I finally got my green card.  Does that mean I am just like a citizen now?

Green Card holders, properly called "legal permanent residents" or LPR are just that,  "permanent residents" of United States.  Residence, however, can be a little tricky.  Most LPR's understand that they cannot vote, as they are not citizens.  However, many LPRs get tripped by residence requirements, as the law presumes that you abandoned residence if you stay out of the country for prolonged periods, and you can loose the LPR status.  The presumption, however can be overcome with right kind of facts supporting it.

I signed a  contract when I took my job.  Now my employer tells me that they own everything I created.  Can I get out of that?

It depends on the scope of contract and scope of employment.  Many employers will have employees sign contracts that give rights to any intellectual property created during the scope of employment to the employer.  Best time to negotiate the contracts is before you sign them!

Why are legal documents so hard to read?  Why can't lawyers write in plain english?

Lawyers can certainly write in plain english, and most do.  However, legal documents contain many terms of art, meaning phrases or words of english that have specific meaning assigned to them over the years through case law.  So, when a specific phrase or word is used, there is history behind it on exactly what it is supposed to mean (or not mean).
